Welcome to Thoroughbreds Magazine (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of our website, newsletters, memberships, and any related digital services (collectively, the “Services”).

1. Use of the Services

1.1 Eligibility

1.2 Personal Use Only

The Services are provided for personal, non-commercial use unless we explicitly authorise otherwise in writing.

1.3 Account Responsibility

If you create an account, you are responsible for:

  • Notifying us immediately of unauthorised access

We reserve the right to suspend or terminate accounts at our discretion.

2. Subscription & Membership

2.1 Free and Paid Memberships

We offer both free and paid membership tiers. Details of pricing and benefits are listed on our website and may change at any time.

2.2 Billing & Renewal

  • Paid memberships renew automatically unless cancelled.

  • Cancellations take effect at the end of the current billing period.

  • By providing payment information, you authorise us (and our third-party processors) to charge applicable fees.

2.3 Refunds

Refunds are handled according to our published Refund Policy (available separately). In general: we will refund you if you contact us within 30 days of payment. Refunds requested outside of this time period are not guaranteed, but we aim to be fair.

3. Editorial Submissions, Pitches & Contributions

3.1 Voluntary Submissions

If you submit a pitch, creative work, interview, self-interview, or other content:

  • You retain ownership of your work.

  • You grant us a non-exclusive, royalty-free license to review and consider your material.

  • We will only publish with your explicit written consent.

Unsolicited submissions do not oblige us to respond or publish.

3.2 No Confidentiality Guarantee

We cannot guarantee confidentiality for unsolicited submissions. If you require an NDA, contact us before you send anything sensitive.

4. Intellectual Property Rights

4.1 Our Content

All content published by Thoroughbreds—including text, design, images, branding, and layout—is protected by copyright and other intellectual property laws.

You may not:

  • Reproduce

  • Distribute

  • Modify

  • Create derivative works

  • Sell or commercially exploit

any part of the Services without our written permission.

4.2 Limited License for Readers

You are granted a personal, non-transferable license to access and read our content for private use only.

5. Acceptable Use

You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us.

You agree not to use the Services to:

  • Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.

  • Delete the copyright or other proprietary rights notice from any Content.

  • Attempt to impersonate another user or person or use the username of another user.

  • Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats ("gifs"), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as "spyware" or "passive collection mechanisms" or "pcms").

  • Interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services.

  • Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Services to you.

  • Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services, or any portion of the Services.

  • Copy or adapt the Services' software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.

  • Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Services.

  • Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including and without limitation, any robot, scraper, or offline reader that accesses the Services, or use or launch any unauthorised script or other software.

  • Use a buying agent or purchasing agent to make purchases on the Services.

  • Make any unauthorised use of the Services, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretences.

  • Use the Services as part of any effort to compete with us or otherwise use the Services and/or the Content for any revenue-generating endeavour or commercial enterprise.

  • Trick, defraud, or mislead us and other users

  • Misrepresent affiliation with Thoroughbreds

We reserve the right to restrict or terminate access for violations.

7.2 Editorial Disclaimer

Opinions expressed in published pieces—including interviews, essays, and commentary—belong to their respective authors and do not necessarily reflect the views of Thoroughbreds. We publish pieces from a variety of lives experiences and perspectives. We do not publish or allow any content that would constitute disinformation, misinformation, or hate speech.

8. Limitation of Liability

To the fullest extent permitted by law, Thoroughbreds Magazine and its team are not liable for:

  • Indirect, incidental, or consequential damages

  • Loss of data, profits, or revenue

  • Any damages arising from unauthorised access, system failures, or third-party issues

Our total liability is limited to the amount paid by you in the previous 12 months, if any.

9. Indemnification

You agree to defend, indemnify, and hold harmless Thoroughbreds Magazine, its editors, employees, and contributors from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

10. Termination

We may suspend or terminate your access to the Services at any time for any reason, including violations of these Terms or legal requirements.

You may terminate your account at any time through your account settings.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Thoroughbreds Magazine operates, without regard to conflict-of-laws principles.

Any disputes will be resolved exclusively in the courts of that jurisdiction.
